The Extent to Which Justified Termination is a Condition when Terminating the Indefinite Labor Contract in Jordanian Legislation

Abstract

This research aims to clarify controls for legitimate termination of the indefinite employment contract, through the extent of justified termination, when terminating the indefinite contract; as provided for in the Jordanian Labor Law and decisions of the Court of Cassation. According to the previous, this research concluded that jurisprudence of the Court of Cassation regarding justified termination of fixed-term employment contracts adopted two directions. The first considers that termination by the employer is to be lawful, in addition to giving notice according to legal controls. As to the second direction, it is considered sufficient for the employer to give notice, according to legal controls, without requirement to base termination on cases provided in Article (28) of the Labor Law; this is the direction supported in this research paper, according to justifications mentioned.
